Terms and Conditions

Canvas USA® is committed to providing exceptional custom marine, residential, and retail products crafted with precision and care. The following terms and conditions govern all quotations, purchases, and services provided by Canvas USA®. By submitting payment, you acknowledge and agree to be bound by these terms, which form a legally binding agreement between you and Canvas USA®. Please review them carefully.

1. Quotation and Pricing

The quotation provided is based exclusively on the information furnished at the time of issuance. For marine products, in the absence of an on-site inspection of the vessel, all prices are provisional and subject to revision upon the vessel’s arrival and subsequent assessment by Canvas USA®. For residential and retail products, prices are contingent upon the specifications provided and may be adjusted following an evaluation of the project site or materials. Canvas USA® reserves the right to modify pricing to reflect actual project requirements, including but not limited to labor, materials, and unforeseen complexities.

2. Order Verification

By submitting payment, you confirm that you have thoroughly reviewed and approved all specifications, including but not limited to colors, dimensions, materials, and descriptions, associated with your order. Canvas USA® shall not be liable for errors or discrepancies arising from unverified or incomplete order details. Any requested revisions post-payment may incur additional charges based on time and materials.

3. Service and Delivery Standards

With over four decades of expertise, Canvas USA® is dedicated to delivering superior craftsmanship across marine, residential, and retail products. However, without our professional installation services, we cannot guarantee precise fastener placements, structural compatibility, or adherence to estimated timelines. All delivery or completion schedules are estimates and subject to change due to factors beyond our control, including material availability, labor constraints, or project complexity.

4. Vessel Drop-Off and Liability

For marine projects requiring vessel drop-off, customers are solely responsible for removing all valuables, personal items, and non-essential equipment from the vessel prior to delivery. Canvas USA® shall not be liable for any loss, theft, or damage to personal property left on the vessel. Customers are advised to secure their belongings to mitigate risks, as Canvas USA® assumes no responsibility for such items.

5. Photo and Intellectual Property Rights

All photographs, designs, or other materials submitted by the customer in connection with an order shall become the exclusive property of Canvas USA®. We reserve all rights to use such materials for promotional, archival, or other purposes without compensation to the customer. Similarly, all designs, prototypes, and custom products created by Canvas USA® remain our intellectual property unless otherwise agreed in writing.

6. Custom Work and Repairs

Charges for custom marine, residential, or retail products, as well as repairs, are determined based on the actual time and materials utilized. A non-refundable deposit, the amount of which will be specified in the quotation, is required for all projects before commencement. Final costs may vary depending on the scope of work, and customers will be notified of any significant deviations from the initial estimate.

7. Custom Product Design and Modifications

Custom products are designed for similar projects or customer-provided specifications. Any modifications requested during the production process will be executed on a time-and-materials basis, with costs communicated to the customer in advance. Due to the bespoke nature of our work, prices for custom orders are not fixed and may fluctuate based on project requirements or material costs.

8. Payment and Chargeback Waiver

Payment for all orders must be made in accordance with the terms specified in the quotation. By electing to pay via credit or debit card, you expressly waive any right to initiate chargebacks or disputes related to the transaction. All payments are final, subject to the terms outlined in this document.

9. Limitation of Liability

Canvas USA® shall not be liable for indirect, incidental, or consequential damages arising from the use of our products or services, including but not limited to delays, installation errors by third parties, or failure to meet customer expectations. Our liability is limited to the amount paid for the specific product or service in question.

10. Governing Law

These terms and conditions shall be governed by and construed by the laws of the state in which Canvas USA® is headquartered, without regard to its conflict of law provisions. Any disputes arising under this agreement shall be resolved in the courts of said state.
